Kelly Rutherford prevented from raising her children in the United States by judge

Kelly Rutherford explained the circumstances of her child custody battle with her ex-husband, Daniel Giersch, when she appeared on NBC's Dateline on November 16.

According to Us Weekly, Giersch's visa has been revoked and after a Los Angeles judge's ruling, their children Hermes, 5, and Helena, 3, have to live in France with their father.

"Why would you take the kids away from their mother, out of their school, away from their friends and everything they've known, and plant them somewhere else? It's hard to even believe it's real," Rutherford said.

The judge also said that Giersch, a self-made millionaire, must provide Rutherford with a plane ticket, a car and a place to stay when she visits France, reports Hollywood Life.

The New York City-based actress can only wait for Giersch's visa to be restored but said, "I'm being punished for being a good mother and taking care of my children, and he's being rewarded for having his visa revoked. Our kids are U.S. citizens and they have a right to be raised in the U.S."
