Judge denies Lance Armstrong’s request to dismiss lawsuit

Judge Darlene Byrne declined to dismiss Acceptance Insurance Holdings’ $3 million lawsuit against Lance Armstrong over bonuses paid between 1999 and 2005.

The company wants its money back because Armstrong admitted that he used performance-enhancing drugs every year that he participated in the Tour de France.

"Here in Texas, if you take money from someone and don't do what you said you would do, we call that fraud," Acceptance Insurance attorney Jim George told the New York Daily News .

Armstrong’s lawyers argued to have the case dismissed because the statute of limitations expired in 2011. The insurance company argued that the statute of limitations began when Armstrong admitted to doping in January this year.
Mark Kincaid, the insurance company’s attorney, wants to question Armstrong under oath.

"Lance Armstrong would be the No. 1 witness," Kincaid told the Associated Press .

Armstrong is facing other lawsuits as well.

SCA Promotions recently filed a $12.1 million lawsuit against Armstrong for bonuses paid between 2002 and 2004.

The federal government recently joined a whistleblower lawsuit filed by former teammate Floyd Landis. The United States Post Office sponsored Armstrong’s teams for several years.
