Man sues doctor who prematurely pronounced wife dead, woman later froze to death at hospital

A California doctor is being sued after declaring a woman dead, while her husband claims she was not dead at all.

Guadalupe Arroyo began to question his wife’s death in 2010 when he went to the White Memorial Medical Center and found his wife’s body face-down in the morgue center with bruises and cuts on her. A court ruled on Wednesday that the suit may proceed with new experts.

According to ABC News Arroyo believes his wife was falsely declared dead and, in an attempt to break free, was frozen to death in the hospital’s freezer where the bodies are held.

The medical center refused to comment, only saying that they “wish to note that we continue to disagree with the allegations being made.”

United Press International reports that the suit was initially for the hospital mishandling Arroyo’s wife’s body, but has now moved to a “prematurely declared dead” suit.

This would not be the first time that a person has woken up in a body bag, Last month a man woke up in a body bag after being pronounced dead. He died two weeks later.
