Sleeping Yankees fan suing team, MLB and ESPN for $10 million (Video)

A sleeping New York Yankees fan woke up, found out that he was being ridiculed online and, a few months later, decided to sue everyone he could think of. Andrew Rector filed a $10 million defamation lawsuit against ESPN, MLB, the team and the announcers who made fun of him while he slept during a nationally televised game against the Boston Red Sox.

Rector actually fell asleep during the April 13 game between the rivals, long before we knew their 2014 seasons would turn out as terrible as they are. In the suit, filed in Brooklyn Superior Court, he does admit to taking a snooze, but he was still not happy with what play-by-play announcers Don Shulman and John Kruk said during his nap, notes The New York Post.

In the suit, which does name Kruk and Shulman as defendants, he says the two gave an “avalanche of disparaging words” during the broadcast. His nap was posted on YouTube a day later and has garnered over 500,000 views.

Rector said that the announcers made “false statements,” suggesting that he is “not worthy” of being a Bronx Bombers fan and “is a fatty cow that need two seats at all time and represent symbol of failure.”

He claims that the announcers made him sound like a “confused” fan, rather than one who understands the Yanks-Sox rivalry. (Although, as Deadspin points out, the announcers never directly insinuated that Rector didn’t know about the history of the teams.) He adds that he has “suffered substantial injury” to his reputation, as well as mental anguish and even “loss of future income and loss of earning capacity.”

Rector’s attorney told the Post, “We’ll settle this in court.”
