Jesse Tyler Ferguson's husband Justin Mikita won't be prosecuted for fatal crash involving Kirstie Alley's daughter's fiance

Jesse Tyler Ferguson’s husband, Justin Mikita, will not be prosecuted in a deadly accident that involved Kirstie Alley’s daughter’s fiancé.

Last November, Mikita hit Nick Trela, 23, who was riding a motorcycle after crossing a double yellow line to make a left – an illegal turn.

Trela died from the accident but TMZ reports Mikita won’t face prosecution for vehicular manslaughter. He is still being sued by Trela’s family.

The L.A. City Attorney came to the conclusion because even though Mikita made an illegal move, Trela was also speeding before they collided. Witnesses have come forward to say Mikita’s turn was not illegal because he crossed over traffic in a break in the yellow line.

"This is a horrible tragedy. I want to respect the family and the process, so I am not going to discuss any details of the accident or the complaint at this time,” Mikita told TMZ.

The Modern Family star married Mikita in July 2013 in New York City.
