Jared Fogle, former Subway spokesman, gets over 15 years in prison

Jared Fogle, the former Subway spokesman, was in court this morning for his sentencing on charges of possessing child pornography and having sex with minors. Fogle pleaded guilty to the charges and was sentenced for 188 months, just over 15 years, in prison.

According to the Indianapolis Star, Fogle will also be supervised for the rest of his life, even after he is released from prison.

Fogle agreed to plead guilty in August. Prosecutors said earlier this month that they will seek a 12-year, seven-month prison sentence, which was the maximum according to the plea deal. Fogle agreed to seek no less than five years.

In addition to prison time, Fogle has already paid out $1 million in restitution to 10 of his 14 victims. The remaining victims were set to receive $100,000 each before today’s hearing.

According to the Indy Star, forensic psychiatrist John Bradford of the University of Ottawa, who testified for the defense by phone, suggested that Fogle might have found sexual intercourse with minors as a substitute for eating.

“Once he lost weight, it seemed as though in a short time he had hyper-sexuality,” Bradford said, noting that he was concerned about the eating disorder Fogle had before college. “There are brain disorders that can be associated with sexual drive.”

Fogle’s attorney, Jeremy Margolis, also said that Fogle “traded a horrible food addiction for a horrible sex addiction.” Margolis also explained why he thought five years was enough for Fogle.

“The time in prison will be harder for him than for prisoners who committed the exact same offense,” Margolis said. “Mr Fogle has destroyed his life. He did it to himself. ... His punishment is not going to stop when he gets out of prison. Sixty months is enough for him to know he'll never do this again.”

Fogle also read out a written statement. At one point, he said that members of his family have also been victims of his wrongdoing and Judge Tanya Walton Pratt interrupted him. “You gave your wife $7 million, so she'll be OK,” the judge said.

Fogle had been a Subway spokesman since 2000. The company immediately terminated their relationship with him after he reached a plea deal.
