Gabriel Aubry, Halle Berry’s ex and the father of her daughter Nahla, will not face criminal charges for the Thanksgiving day brawl with her current fiancé Olivier Martinez that left both men bruised and banged up.
Law enforcement sources told TMZ that it’s highly unlikely that Aubry will get formally face any criminal prosecution.
Aubry was arrested for battery after he and Maritnez got into a physical altercation when Aubry dropped off Nahla at Berry’s home on Thanksgiving morning.
On Thursday, the case will be sent to the L.A. City Attorney's Office. From there, police will make a decision on whether or not charge Aubry with battery but the law enforcement sources that spoke to TMZ say that it’s been largely decided that the fight was "mutual combat."
Aubry was in court this week to take care of the restraining order that Berry has on him, asking them to eliminate the restraining order that doesn’t allow him to see his daughter. A judge shot down his request but the emergency order expires on Thursday.
