California law to presume Kim Kardashian's baby-daddy is Kris Humphries

Kim Kardashian is already in a heated legal battle with soon-to-be ex Kris Humphries. Now, she will have to prove legally that Kris is not her baby’s father under California law.

According to TMZ, California law states that because Kim and Kris are still legally married, the state automatically recognizes Kris as the father of the unborn child, until proven otherwise.

If the NBA star attempts to claim the child as his own, then Kanye and the Keeping Up with the Kardashians starlet would have to provide “clear and convincing evidence” that the child was fathered by Kanye.

Fans know that the baby’s father is certainly Kanye, as the child is believed to have been conceived three months ago, while Kim and Kanye were in Rome.

In the meantime, Kris and Kim have been engaged in a bitter divorce battle. Kris wants Kim to admit their marriage was a fraud and her to return her massive $2 million engagement ring, Huffington Post Reports. The two were only married for 72 days.

Kim confirmed she was expecting with Kanye on New Year’s Eve.
