Lindsay Lohan was a no-show in court this morning in New York. She was supposed to appear in her first hearing in connection with her alleged November nightclub fight with Tiffany Ava Mitchell.
Lohan was arrested the morning of Nov. 29 for assaulting Mitchell, who was later revealed to be a psychic from Palm Beach, Florida who was visiting New York with her husband.
According to ABC News, Lohan’s attorney, Mark Jay Heller, told reporters today that she “never made any physical contact with the alleged victim,” who was trying to read Lohan’s palm at the time.
“From my understanding, Lindsay was being approached by a fortune teller who sought to provide a reading to her and she politely said ‘I don’t want to participate’ and declined,” Heller explained. “You would think if [Mitchell] was a fortune teller, she would have been able to see this happening in advance. But obviously her skills weren’t that honed.”
Heller added that Lohan only wanted to be left alone and did not commit any crime. He said that she will only go to court if an accusatory document is filed, which hasn’t happened yet.
TMZ reports that prosecutors have delayed the case. “The investigation into this case is continuing,” they announced.
After the incident, Mitchell’s husband, Wayne Stevens, told ABC News, “I don't even know why [Lohan] pushed her...And we didn't realize who it even was. Five minutes later, she comes around and tells my wife, 'If I need space,' and then she just punched her.”
Lohan spent New Year’s Day in London, where she is reportedly still hanging out.
