Real Housewives of Atlanta star, Kandi Burruss, is suing former co-star Kim Zolciak over copyright infringement allegations in regards to Zolciak’s song “Tardy for the Party.”
Burruss, a Grammy award winner, actually wrote the song for Zolciak. Both women have spin-off shows on Bravo.
According to RadarOnline, another Real Housewives cast-member is representing Burruss in court, Phaedra Parks. The lawsuit was filed on March 12.
In it, Burruss and co-songwriter Rodney Richard claim that Zocliak “marketed and sold the Infringing Single in various formats (e.g., compact disc, downloadable audio track, DVD, etc) and through various websites, all without Plaintiffs’ license, consent or authorization.” She asks for a temporary restraining order to prevent any future sales of the song.
Burruss and Richard are also asking Zolciak to reveal exactly how much of a profit she made form the song. They’re also seeking punitive damages, attorney’s fees, and a jury trial.
Burruss has written on her Bravo blog about the situation, “I hardly got anything from Tardy for the Party. That is the truth. I am not mad about it. I really blame myself because I didn’t handle my business correctly.”
Zolciak has responded to the lawsuit to TooFab, saying "This is nothing short of a publicity stunt, I find this lawsuit funny yet sad. Coming after me now and this song is 4 years old? I have in fact overpaid Kandi and have documents to prove it and my legal team will handle this accordingly."
