Katherine Heigl suing drug store Duane Reade over unauthorized photo use

Actress Katherine Heigl filed a lawsuit against a drug store chain for allegedly using her photo in their advertising.

According to TMZ, who first reported the lawsuit, the photo was one taken by a paparazzi where she can be seen carrying a bag from New York drug chain Duane Reade.

The drug store saw the photo and took to social media back in March with the tweet: "Love a quick #DuaneReade run? Even @KatieHeigl can't resist shopping #NYC's favorite drugstore."

Reuters reports the lawsuit was filed on Wednesday and seeks $6 million plus damages for using her name and image. The complaint says Heigl plans on donating any winnings to The Jason Debus Heigl Foundation.

Duane Reade posted the photo, which contains the JustJared logo, both on Twitter and Facebook. The lawsuit says that Heigl "is highly selective and well compensated" when it comes to endorsing products.

While the drug store chain hasn't commented on the lawsuit, the actress' attorney, Peter Haviland said, "we expect Duane Reade to pay for its willful misuse of Katharine Heigl's name and likeness."
