Brian Austin Green suing former ‘90210’ co-star over unpaid $200,000 loan

Brian Austin Green is suing his former Beverly Hills 90210 co-star and ex-girlfriend, Vanessa Marcil-Giovinazzo, over a $200,000 loan that he alleges she never paid back. Marcil-Giovinazzo is also the mother of Green’s nine-year-old daughter.

According to TMZ, the lawsuit, which was filed in Los Angeles County Superior Court, alleges that Green first gave Marcil-Giovinazzo $50,000 in 2000 while they were dating and before she became pregnant. In total, Green alleges that he gave her $200,000, but was never paid back.

E! News reports that the lawsuit specifies that Marcil-Giovinazzo agreed to pay the money back under the understanding that the loan was not a gift. He is specifically suing her for breach of contract, breach of oral agreement and negligent misrepresentation, notes E! News.

TMZ adds that whenever Green had asked Marcil-Gionvinazzo for the money, she agreed to “promptly” repay him. The last time he asked in November, she refused, which prompted Green to file his lawsuit on Friday. He is also seeking unspecified damages in addition to the $200,000.

Marcil-Giovinazzo has since married CSI: New York actor Carmine Giovinazzo and won an Emmy in 2003 for her General Hospital role, notes Reuters. On 90210, she played the cousin of Tori Spelling’s character.

Green is currently married to former Transformers star Megan Fox. He recently appeared on Desperate Housewives, Smallville and Terminator: The Sarah Connor Chronicles.

Green and Marcil-Giovinazzo’s child, Kassius Lijah, was born on March 30, 2002.
