CBS appeals Super Bowl fine

Network says fine is unconstitutional; FCC plans to fight appeal in court

CBS asked a federal appeals judge to overturn a fine for indecency by the Federal Communication Commission as a result of the infamous 2004 Super Bowl halftime show.

The FCC fined 20 CBS stations a total of $550,000 when Janet Jackson's breast appeared at the end of the show, something she called a "wardrobe malfunction."

According to the Associated Press, The television network argued the fine was "unconstitutional, contrary to the Communications Act and FCC rules and generally arbitrary, capricious and contrary to law." The station did apologize for the indecent in court records, according to the AP.

The FCC looks to be settling in for a fight.

"CBS' continued insistence that the halftime show was not indecent demonstrates that it is out of touch with the American people," FCC spokeswoman Tamara Lipper told the AP. "Millions of parents, as well as Congress, understand what CBS does not: Janet Jackson's 'wardrobe malfunction' was indeed indecent."
