Dane and Gayheart Respond to Racy Video Leak

Grey's Anatomy star Eric Dane, his wife Rebecca Gayheart and former beauty queen and "Celebrity Rehab" cast member Kari Ann Peniche are responding to the leak of their racy Web video, according to MSNBC.com.

On Monday, Gawker posted excerpts from a tape that features the three nude in a bedroom and a bathroom. The 12-minute video was reportedly shot in Peniche's apartment two years ago. In the video, Gayheart also says she's high.

Tuesday morning, a lawyer for Dane and Gayheart issued a statement.

"Although the participants are nude, the tape is not a 'sex tape.' It is a private tape made for only my clients' personal use," attorney Marty Singer said in the statement. "If anyone exploits the tape, they will be violating my clients' rights and will be exposed to significant liability."

A rep for Peniche also spoke on the scandal, saying, "This is an unfortunate incident where consenting adults who were having a little fun are now victims of having personal property stolen and private matters made public."

The tape may have been released when country star Mindy McCready, Peniche's roommate following their appearance on "Celebrity Rehab," allegedly stole Peniche's computer hard drive, which contained the footage, after an argument about money.
