Fine Against CBS for Wardrobe Malfunction Reconsidered
Seriously? This again? Yes, apparently the Janet Jackson wardrobe malfunction case is still going on. Currently, the 3rd U.S. Circuit Court of Appeals in Philadelphia is considering whether the FCC's $550,000 fine on CBS's coverage of Janet Jackson's non-coverage is permissible.
In case you've been living under a rock, or if you were just too young at the time to remember because it was a ridiculous number of years ago to still be going on - six to be exact - back during the 2004 Super Bowl halftime show, Justin Timberlake pulled on a piece of Janet Jackson's clothing and caused a bit of her nipple to show as the two danced on stage. CBS' cameras caught and aired a brief second of what was deemed a "wardrobe malfunction." The exposed skin caused a nationwide panic.
Last year, the U.S. Supreme Court asked for the court to take into reconsideration the reinstating of the fine after it was decided in another case that the FCC could fine for even fleeting profanity. The case was previously thrown out in 2008 when the FCC "acted arbitrarily and capriciously."
