Gosselin Lawyers Give Conflicting Accounts

The lawyers for Jon and Kate Gosselin are in disagreement over which client will be held responsible for contempt of court.

Forget the problems between Jon and Kate Gosselin. The soon-to-be-divorced couple's lawyers are now the ones doing battle.

Mark Heller, Jon's attorney, informed People magazine on Friday that his client had fulfilled all obligations concerning the October court order to return money to a joint bank account. When asked if all $180,000 that Kate claimed to be missing was returned, Heller evaded details.

"I can tell you that we've done what we need to do to extricate Jon from any issues concerning contempt," Heller said.

While he assured that Jon was covered, Heller indicated that Kate had not fulfilled her end of the deal. According to Heller, she has not yet accounted for the $55,000 that she withdrew for household expenses.

"Unless something happens today [with Kate] she will be going through contempt proceedings Monday," Heller said.

Mark Momjian, Kate's lawyer, agrees that court on Monday is a possibility, but for completely different reasons. Usmagazine.com spoke with Mark Momjian and received a radically different story. In the interview, Momjian makes no mention of wrongdoing on his client's part, but does claim that Jon has not returned the necessary amount of money.

"The only proof of money we received is $28,500 that was sent over a week ago," Momjian said. "The only thing we're looking for is the difference, which is about $151,500. We have not yet received confirmation of that."

When asked what the consequences would be if this amount was not in the account by Monday, Momjian replied, "We'll be in court. We'll be in court."
