Gossip Girl Star to Become On and Off Screen Single Mom

Earlier this month, the television actress filed for divorce from her estranged husband of two years, entrepreneur David Giersch, who coincidentally filed for a separation the same day.

The divorce turned ugly this week as Rutherford filed emergency papers on January 9, seeking to bar Giersch, 34, from traveling outside the United States with their 2-year-old son, Hermes, fearing that Giersch will vanish with their son.

People reported that Giersch countered her suspicions in an L.A. Superior Court with papers alleging that the actress, who's four months pregnant with their second child, has a bad temper, once throwing a laptop at him and another time trying to sock him with her fist.

Both are seeking sole physical custody.

A court date has yet to be set.
