The DUI case of actor Mitchel Musso, known for his role as Oliver Okin on the Disney series Hannah Montana, has been postponed.

Musso’s arraignment was scheduled for Thursday in Los Angeles. It has now been pushed back until Dec. 9.

He was charged in October with a DUI in Burbank, CA. Police pulled him over when he didn’t slow down as he approached the scene of a traffic accident. A field sobriety test revealed that his blood-alcohol level was above the legal limit of .08. He is also under the age of 21, making any alcohol consumption on his part illegal. Musso’s $5,000 bail was later waived because he had no previous offenses.

Musso faces six months in jail and a $1,000 fine. He was unavailable for comment.
Musso also provides the voice of Jeremy Johnson on Phineas and Ferb and stars in the series Pair of Kings.
