The claim filed by cast members of the series Happy Days in April was thrown out of court Wednesday.
The cast filed the $10 million suit against CBS, claiming the network violated breach of contract and owed them for merchandising revenues. The actors claimed they were guaranteed five percent of royalties for the use of their images.
They also gave interviews about the suit to CNN. However, Los Angeles Superior Court Judge Elizabeth Allen White ruled in favor of CBS by throwing the fraud claim out.
"The exact details of this alleged promise to provide periodic revenue statements when merchandising revenue had been generated have not been plead with the requisite level of specificity required,” the court ruling read.
A spokesperson for CBS stated that the network is pleased with the outcome.
“We intend to press forward with the lawsuit,” said Jon Pfeiffer, an attorney for the Days actors. “If we can’t punish the defendants, we certainly intend to expose their practices.”
