With the writers strike going strong since November 5th, the crop of new freshly-written shows is virtually non existent. Late night talk shows stopped production due to the fact that the writers couldn't work. According to MarketWatch, there was a deal made with Worldwide Pants, the production company of CBS's "Late Show with David Letterman" and the "Late Late Show with Craig Ferguson," to have their writers come back. NBC's "Late Night With Conan O'Brien" and ABC's "Jimmy Kimmel Live" returned sans writing staff, but managed not defy the WGA.

This action could land him in hot water since he is a member of the writers guild. It isn't clear what will happen if he keeps writing his opening monologues, but he could be brought before the WGA disciplinary committee, according to Goldman.
