Kelly Rutherford Wins Custody Case

A Los Angeles judge ruled in favor of Kelly Rutherford's request to take her son to New York, on Friday. Kelly will be allowed to take her son, Hermes, with her to continue filming for the show, Gossip Girl, through March.

According to People.com, Judge Michael Levanas felt that taking Hermes away from his mother and leaving him to his father, Daniel Giersch, so suddenly, would do more damage than good.

The judge stated that he wanted "the plan least likely to cause trauma to [Hermes]." Hermes, 2, would have spent multiple nights away from his mother for the first time had he not been able to go to New York with Kelly.

With the next hearing in the couple's case scheduled for April, the judge mentioned that he was proud of both parents' composure throughout the hearing.
