Kelly Rutherford's Custody Issue Resolved

Kelly Rutherford's custody battle is over, for now.

Los Angeles judge Michael Levanas ruled today that Gossip Girl actress Kelly Rutherford is allowed to take her 2-year-old son, Hermes, to New York until the end of March, reports People magazine.

Levanas said that it would be detrimental to the boy to leave him in L.A. with his father while his mother is in New York. He believes that this plan is "least likely to cause trauma [to Hermes]." According to Star Magazine, Rutherford's lawyer, Lance Spiegel, also believes the child should have access to both parents and that Giersch had not shown any reason why he can't be in Manhattan through March when Gossip Girl is finished filming the season.

E! Online says that Giersch will be going with the pair to New York. He will have visits lasting a minimum of seven hours and will also be allowed overnights beginning with one per week and gradually increasing to three.

Rutherford is currently pregnant with the couple's second child, due in June.
