McMahon Sues Hospital

Ed McMahon is suing Cedars-Sinai Medical Center, claiming they discharged him with a broken neck.

Ed McMahon, Johnny Carson's former sidekick on NBC's Tonight Show, is suing Cedars-Sinai Medical Center, reports BBC News. McMahon, 85, claims that the hospital did not diagnose him properly.

McMahon believes that his two spine operations were not performed correctly and the hospital discharged him with a broken neck. He has been complaining of discomfort and pain for months.

McMahon is also suing Robert Day, the founder of the investment management firm, TCW Group, according to TMZ. McMahon went to the billionaire's home in 2007 and fell and broke his neck on "unsafe entry stairs" that had no handrails.

The lawsuit filed against the hospital claims that doctors "failed to take an X-ray of McMahon's cervical spine, in spite of his complaints of severe neck pain." It also claims elder abuse because such patients are prone to these injuries and Cedars should have been more aware of that.

"We had hoped to avoid a lawsuit, but our discussions were not fruitful and we were left with no other options," said Howard Bragman, McMahon's rep. "That being said, we believe our suit has great merit and we expect a favorable resolution."

Cedars has yet to respond to the lawsuit's claims.
