Oprah vs. Mutual of Omaha Bank

Oprah Winfrey and Nebraska-based Mutual of Omaha Bank dispute over the use of the "aha moment" phrase.

Once upon a time there was "ahoy," "ahem" and "ahhh." And then there was Oprah Winfrey and "the aha moment." Who knew that the last three words would spell lawsuit?

Mutual of Omaha Bank, whose Web page greets viewers with "the official site of the aha moment," filed suit against Ms. O for using their slogan as her own catchphrase. It's like an I-said-it-first kind of thing.

However, Winfrey's lawyers conclude their client objected to the business's advertising campaign. They in turn, sent a cease and desist letter saying she owns the right to use it, which is during a moment of revelation on her show.

Nonetheless, Times of India reports the Omaha bank said Oprah "abandoned"her rights by failing to "police the alleged mark," when other companies used it in advance.

According to TMZ, the suit against the talk show sensation was filed in a federal court in Nebraska on April 22.
