Eminem's Lawsuit Against Apple Goes On

Federal judge grants the rapper's lawsuit against Apple Computer the OK.

Eminem's lawsuit against Apple Computer Inc. has been given permission by U.S. District Judge Anna Diggs Taylor to proceed. The rapper is charging Apple with using his song "Lose Yourself" in an iTunes Music Store commercial. The advertisement depicted a boy wearing an iPod singing the lyrics of Eminem's hit song, which was the theme for the film "8 Mile." Eminem claims that Apple's advertising company, TBWA/Chiat/Day, approached him about using the song, but when he refused they apparently used it anyway.

Eminem stresses that he has never nationally endorsed a commercial product, and for him to do so would require a sizable amount of money -"possibly in excess of $10 million," his lawsuit says. Apple's lawyers have argued that people viewing the ad would not likely interpret it as an Eminem endorsement.
