Hospital Disputes Ed McMahon’s Lawsuit Claims

Former Tonight Show sidekick, Ed McMahon’s, legal battles continue this week with his lawsuit against L.A. hospital Cedars Sinai Medical Center.
According to People, attorneys for the hospital are hoping that the court dismisses McMahon’s claims. On Wednesday, they filed papers saying that McMahon has no substantial proof to back up his allegations of fraud, battery, elder abuse, and emotional distress, the Associated Press reports.
The 85-year-old TV personality veteran claims that his trouble with Cedars Sinai contributed to his current financial crisis. According to the Superior Court suit McMahon filed last month, he tumbled on "unsafe entry stairs" at a March 2007 dinner party at the home of Robert Day, founder of the investment management firm, TCW Group.
In his suit, McMahon alleges that a doctor failed to diagnose him correctly after he was rushed to Cedars. The doctor discharged him, only to have McMahon discover, weeks later, that he had a neck injury. The treatment, which included spinal surgery, "fell below the applicable standard of care," McMahon's legal papers claim.
Next month, a judge will determine if any of McMahon's claims should be dismissed.
