Pop singer Britney Spears will likely face a trial next month for a misdemeanor charge of driving without a valid California state driver’s license after a judge ruled against reducing or dismissing the charge, according to the Associated Press.
J. Michael Flanagan, Spears’s lawyer, said the charge is going to a trial by jury due to “unfavorable treatment” by prosecutors and the judge. He has insinuated that they are trying to make an example out of the singer.
Flanagan attempted to get the charge reduced or dismissed Thursday but was unsuccessful. Flanagan argued that under normal circumstances, Spears would be allowed to pay a $10 fine and avoid criminal prosecution.
He has argued that Spears is being treated unfairly because of her celebrity status, though prosecutors have argued that being a celebrity does not warrant dismissing a case.
If the case begins as scheduled on Oct. 15, Flanagan said he will not call witnesses or do anything more than issue opening and closing statements.
"I'm just going to sit there," he said. Flanagan will appeal if Spears is convicted of the misdemeanor.
The 26-year-old singer was accused of a hit-and-run incident in August 2007, though the hit-and-run was settled with the owner of the car.
