Locklear Officially Charged
18-Nov-2008
Written by: Marissa Willman
Actress Heather Locklear was officially charged with a misdemeanor for driving under the influence of prescription drugs on Monday.
After an odd driving escapade led to her arrest, the Santa Barbara, Calif. District Attorney’s office said actress Heather Locklear has formally been charged with a misdemeanor count of driving under the influence of drugs, according to People magazine.
Locklear, who was originally charged with driving under the influence of drugs and being under the influence of a controlled substance, will not be charged with the second count since authorities have ruled that the 37-year old actress was only under the influence of prescription medications.
"Lab tests showed she had no alcohol in her system and no illegal narcotics of any kind," said Senior Deputy District Attorney Lee Carter. "We believe that the prescriptions she was taking could have impaired her ability to drive a motor vehicle safely."
The specific medications that Locklear had taken, as well as the amounts, were not revealed.
A felony charge was not pressed against Locklear since there were no injuries. Carter said DUIs with no injuries are always filed as misdemeanors.
Locklear was arrested on Sept. 27 in Montecito after a 911 call claimed the actress was driving erratically. An arraignment is set for Jan. 26 in Santa Barbara Superior Court. If convicted, Locklear could face a fine and up to six months in jail for the misdemeanor charge.
