Oprah Facing Lawsuit for Trademark Infringement
Oprah Winfrey has created an "aha moment" where she asks actors, writers and athletes to share their inspirational moments.
According to the Associated Press, Mutual of Omaha, an insurance company, is suing Winfrey and her production company over use of the phrase, "aha moment."
LaLate.com reports, Winfrey's company demanded Mutual to cease their use of the phrase for promotion and financial products. In retaliation, Mutual filed a lawsuit Wednesday.
In a statement Friday, Mutual claimed it had been granted preliminary approval of a federal trademark for the slogan, "official sponsor of the aha moment," reports the AP. This became part of the Omaha based insurance company's national advertising in February. Mutual said Winfrey and Harpo Productions Inc. are claiming rights to the phrase, "aha moment."
Harpo is hoping to reach a reasonable resolution with Mutual, said Lisa Halliday, spokeswoman for Harpo.
Owning a national trademark is similar to that of a copyright. A government office must approve the mark, fees must be paid, and then it is available for commercial use.
