Birkhead Gives Damaging Evidence Of Smith's Drug Use
Larry Birkhead provided disturbing testimony at a preliminary hearing on Friday meant to determine whether there was enough evidence to continue with a trial against Anna Nicole Smith's former doctors and lawyer.
Doctors Sandeep Kapoor and Khristine Eroshevich and lawyer Howard K. Stern could be tried for almost 24 felony counts related to Smith's medication intake. Many of Birkhead's statements indicate that the three made questionable judgments that could have lead to death.
Birkhead told Los Angeles Superior Court Judge Robert J. Perry that upon consulting Kapoor about the excess of pills Smith took, he was assured that everything was "under control."
Based on her seeming dependence on methadone, Klonopin, Topamax, and Xanax, Birkhead disagreed.
"I felt she took medication in excess," he testified.
He also went on to further inform the judge that Smith's drug dependence continued, and perhaps even intensified, while she was pregnant with their daughter, Dannielynn.
In regards to Sterns role in Smith's death, Birkhead claimed the lawyer sought repeated assurance from both Birkhead and Smith that the medications had been taken.
