After another denial of Polanski's bail, his lawyers have reconsidered the idea of his return to the U.S.

Roman Polanski's lawyers could be accepting defeat.

After being denied another appeal to release the director on bail during the extradition proceedings in Switzerland, the lawyers have considered a new strategy: that Polanski may be released and able to return to the United States to explain himself in his flight from the 1977 sexual assault case, according to nytimes.com.

Before Wednesday, lawyers never suggested that Polanski would return to the U.S. to face charges. But the Swiss court is unwavering in their decision to hold Polanski in jail, which most likely accounts for the sudden reconsideration of his return. Polanski's lawyers have repeatedly argued that jail is not an appropriate place for a man of Polanski's age (76), who they claim is not in perfect health.

Polanski has received open support from members of the film industry in the United States, which could prove advantageous to Polanski's fate over here. An actual pardon from the victim herself, Samantha Geimer, is also hoped for his defense.
