Sandra Bullock and her husband, Jesse James, are seeking full custody of James's five-year-old daughter, Sunny, from his previous marriage to porn actress Janine Lindemulder. The couple has been raising the child since January of 2009 and proceeded with the custody suit since Lindemulder's release from prison.

Lindemulder, 40, star of over 100 pornographic movies of a mostly lesbian nature with titles such as Where The Boys Aren't, Sleeping Booty and Dyke Diner, was serving a six-month prison sentence in Oregon for tax evasion. She has just been released and remains in a halfway house in Los Angeles until the end of this year when she can apply for custody of her daughter.

Lindemulder and James were married in 2002 on the Discovery Channel show Motorcycle Mania 3. James left Janine to be with Bullock in 2003 while she was seven-months pregnant. It was during that time Lindemulder claims the stress left her unable to pay her taxes.

Lindemulder reportedly still owes $318,000 in back taxes.

James has filed legal documents in Orange County, asking a judge to rule on whether Lindemulder is a fit mother. In a statement to the court, James said good cause exists for the court to conduct a review to determine if Sunny will be safe with Lindemulder.

"She should be restrained from allowing the child around pornographers, drug addicts, guns and firearms, felons and other unsafe environments," said court papers.

The Judge is expected to rule on whether Lindemulder, James and Bullock will have to appear in court and testify.

James has two teenage children from his first marriage, while Bullock admitted she wanted to have children but put her career first. Reports allege Lindemulder sent her former husband a bitter text message while incarcerated that read: "U win. Sandra finally has her baby - congratulations."
