Still No DNA Test for Howard K. Stern

A DNA test to determine the father of the late Anna Nicole Smith’s baby daughter has been delayed yet again.
An LA judge refused to order a paternity test on Tuesday for Anna Nicole Smith’s companion, Howard K. Stern, in the custody battle of her baby girl Danielynn.
Smith’s ex-boyfriend, photographer Larry Birkhead, asked that Stern be ordered to come to California from the Bahamas for a paternity test. Los Angeles Superior Court Judge Robert Schnider denied the request, but left open the possibility that Stern may be asked for a DNA sample at a later time. This decision comes ten days after Smith was finally laid to rest in the Bahamas, next to her son Daniel.
Judge Schnider denied Birkhead’s request because he said Birkhead's attorneys did not follow proper procedure in presenting their motion. Another hearing will be held in the end of March.
Stern is listed as the father on 6-month-old Danielynn’s birth certificate, but Birkhead has maintained that he is the father.
"I've been putting a nursery together, so I'm smiling," he told reporters. "I'm in a good mood. There's one way to end it. I'm prepared to take the test. I've always been prepared to take the test. If everybody wants to take the test and get it over with and then we have no problem."
A third possibility for the child’s father is Prince Frederic von Anhalt, the husband of actress Zsa Zsa Gabor. He has also filed legal papers claiming he is Danielynn’s father.
Stern and Danielynn remain in the Bahamas where they lived with Smith before her death at a Florida hotel on February 8th.
