Custody Case for Dannielynn Up in the Air

A decision has not been reached in Bahamian court concerning custody of Anna Nicole Smith's baby daughter.

The custody case for Anna Nicole Smith's baby daughter has not yet been closed. A Bahamas court adjourned Friday without coming to a decision concerning 7-month-old Dannielynn.

Howard K. Stern made a brief statement outside the courtroom announcing that nothing had been decided. He also revealed that he's working with Larry Birkhead, the child's biological father, to make a transition. "He's doing a great job," said Stern of Birkhead.

DNA results revealing LA based photographer Birkhead, 34, as the biological father were announced on Tuesday. Since then, Birkhead has said he is not planning to share custody.

"It would imply that I'm unfit as a parent, which I'm not," Birkhead said on the Today show. We might go from one fight to another, but I'm hoping that's not the case because, you know, there's only one dad, and I have no problem with anyone that has good intentions being allowed to visit the baby and see the baby and be a part of the baby's life."

Meanwhile, Anna Nicole Smith's mother, Vergie Arthur, said she would fight for joint custody if talks fail. "We intend to proceed on that application unless something else comes along that causes us not to have to take that course of action," said Arthur's attorney, Debra Rose.

Arthur also told reporters, "I'm happy that Dannielynn will know who her real father is. I look forward to working with Larry raising my granddaughter." Another hearing in the custody battle is scheduled for next Friday.
