Actress Kelly Rutherford has been suffering through a very long custody battle with ex-husband Daniel Giersch for their two children, Helena, 3, and Hermes, 6, and opened up to E! News about the situation.

A judge ruled back in August that the children should live in Monaco with their father, since he does not have a visa to come to the US and Rutherford's schedule allows her to visit them.

A source told Us Weekly at the time that Giersch was happy with the result, stating that "otherwise he would have been cut off completely from the kids. Now they can really have two parents in their lives, which he feels is best for them."

Now, 44-year-old Rutherford is living at a friend's apartment while she fights a costly battle for her children. She told E! that she has "spent every penny. Every penny from Gossip Girl, my pension, my stocks has been spent fighting for my children."

Rutherford is not happy with the current arrangement and compares visiting her kids in Monaco and having to leave them after to "being in a park full of laughing happy children, and then the next day you walk by the park and it's empty."

The actress revealed that the whole thing has taken a toll on their kids as well, stating that she has had to "peel my son off my body, screaming, 'Mama, save me!' when I had to give him to his father—not because he doesn't love his dad, but because he's too young and it was like a forced thing."
