After topless photos of Duchess Kate Middleton on vacation were published in a French magazine last September, an investigation was launched, finding a magazine executive and woman photographer to be at fault.

31-year-old Middleton and 30-year old Prince William were "saddened" and "disappointed" when the photos surfaced last year, a source told Us Weekly.

Now, Ernesto Mauri, publisher of Closer magazine, where the photos were published, and a photographer named Valerie Suau have been charged with "invasion of privacy" for the photos, reports the Telegraph.

Suau works for the newspaper La Provence and was charged for taking photos of Middleton in a swimsuit, but it is still unclear whether she took the topless photos as well.

However, a source in Paris told Us Weekly that Suau used a long lens to shoot the photos from a public road a half mile away from Chateau d' Autet, where the couple was staying.

A source at the newspaper said of the photographer, "She is not concerned."

Middleton's lawyer claimed that the photos were "grotesque breach of privacy" and Mauri and Suau could both face a criminal trial.
