In a odd new lawsuit, Jessica Simpson is being sued by a man named Christopher Hurst, who claims Simpson posed with his infant for a magazine cover to make it appear as if the child were hers.

According to TMZ, a lawsuit uncovered by The Times Picayune states that Hurst was in a shopping in Dillards in 2011 with his teenage daughter and infant son. Customers who spent more than $50 were given the opportunity to meet Simpson, who was pregnant with daughter Maxwell at the time, someone suggested he allow Simpson to hold the baby. A photog came by and snapped the picture.

"When Hurst handed Christopher to Simpson, at least one previously unseen photographer hurriedly moved to the front of the line and began taking pictures of the child," the lawsuit explains. "The photographer did not identify himself or ask Hurst's permission to take or disseminate any photographs of Christopher."

The photo of Simpson and Hurt’s baby later appeared on the cover of OK! Magazine with the headline, “My First Days as a New Mom.”

“What happened in this situation was wrong," said Michael North, Hurst’s attorney. "It's not something that ever should happen. Our immediate aim is to find out how it happened and why it happened and determine who is responsible."

The Hurst family is seeking compensation for emotional distress totaling $75,000.
