Amanda Bynes was absent from her court appearance for her 2012 DUI arrest Tuesday. Her lawyer claims that the Easy A actress is “mentally unfit to stand trial.”

TMZ reports that Bynes’ lawyer told the judge that the 27-year-old former actress lacked the mental capacity to understand her legal proceedings. The case was transferred to the mental health court, where Bynes will face a hearing to determine her mental competency.

Bynes was arrested in April 2012 when she reportedly side swept a cop car in West Hollywood. She pled “not guilty” to one count of misdemeanor DUI, the Huffington Post reports.

Bynes is currently under psychiatric care. The troubled star first entered the hospital in July after she started a fire in a residential driveway. Her stay originally was planned to be short term, but last month, a judge granted Bynes’ doctors’ request to make it long term.

Months of erratic behavior preceded Bynes’ admittance to the hospital. Earlier this year, the Bynes posted half naked selfies of her self on Twitter, and in May, Bynes was arrested for allegedly tossing a bong out of her New York apartment window.
