Lady Gaga is going to trial as the lawsuit brought by her ex-assistant is being allowed to move forward.
U.S District Judge Paul Gardephe ruled on Tuesday that the former assistant will be allowed to bring her lawsuit before a jury in November, Fox News reports.
The jury will get to decide whether the mother monster owes Jennifer O'Neill overtime pay and that the assistant was on-call 24 hours a day. O'Neill worked for Gaga for 13 months and was expected to be available all day.
The judge ruled that because O'Neill was expected to be available all day long, the singer might owe the her overtime pay as a result.
According to NBC News, O'Neill was paid $50,000 for the first year, which was then bumped up to $75,000 the second.
In the written decision by the judge, it's noted that O'Neill had to share a bed with the "Born This Way" singer because she didn't get her own hotel room while on tour. O'Neill was also expected to deal with anything the singer needed throughout the night.
The former assistant said in a deposition, "Every day is a work day for her, so every day is a work day for the rest of us."
"There is no 'We're going to stay in, we're going to sleep.' There is no, 'Let's put on sweatpants and go out to the movies and be girlfriends.' It doesn't work like that," she added.
