Nicollette Sheridan should try to move on from her lawsuit against ABC and Desperate Housewives creator Marc Cherry, at least as far as the justice system is concerned. A judge has denied a request to keep the lawsuit going. A new trial was set to start in December.
Sheridan has been suing for $20 million over a 2008 incident in which she claims Cherry struck her and was abusive. She had said that complaining about the incident lead to her character being killed off. The case ended up going to trial in early 2012 and a judge declared a mistrial, since the jury couldn’t reach a verdict.
Now, the actress had hoped for another trial, but according to the Hollywood Reporter, a Los Angeles Superior Court judge accepted a summary judgement that called for the case to be dismissed. If the case was going to trial again, it would have started on Dec. 2.
Deadline reports that Judge Michael Stern noted that Sheridan never filed a California Labor Commission complaint within a six-month window after the alleged incident took place.
During the 2012 trial, Cherry and other producers actually testified, with Cherry admitting that he “tapped” Sheridan to demonstrate a gag. He said that he had plans to kill off her character long before the incident.
Sheridan has not done much work since leaving Housewives in 2009. She has appeared in a few made-for-TV movies, including the upcoming The Christmas Spirit.
