Tracy Morgan had a better day at the hospital on Thursday, a spokesperson for the comedian and actor said. Morgan has been at a hospital in critical condition since Saturday, when his limo was involved in a car crash on the New Jersey Turnpike.

“While Tracy remains in critical, but stable, condition, he continues to show signs of improvement,” the rep said in a statement to People. “His medical team remains optimistic that his recovery is progressing.”

The statement came in a day after Walmart truck driver Kevin Roper pleaded not guilty in court on Wednesday. He is being charged with vehicular homicide and assault by auto.

Prosecutors allege that Roper had gone 24 hours without sleep before taking the wheel. He did not see that traffic had slowed Saturday morning and tried to swerve, hitting Morgan’s limo.

The actor’s limo then overturned, killing his mentor, James McNair. Comedian Artie Fuqua was also seriously injured in the crash and a video of him being pulled from the vehicle surfaced on TMZ. Fuqua’s daughter, along with Judd Apatow and Louis C.K., have asked TMZ to pull the video.

Morgan is being treated at Robert Wood Johnson University Hospital in New Brunswick, New Jersey. His fiancee, Megan Wollover is by his side. He had successful leg surgery Saturday.
