Actor and comedian Tracy Morgan remains in the hospital, over a week since he was involved in a fatal car accident in New Jersey. A rep for the former 30 Rock star gave an update on his condition Monday, sharing some good news.

“Happy to pass along that Tracy has been upgraded to fair condition, which is a great improvement,” rep Lewis Kay said in a statement to The Hollywood Reporter and other media outlets. “His personality is certainly starting to come back as well.”

Morgan’s assistant, Jeff Millea, has also been upgraded to fair condition, Kay confirmed.

The comedian and his group were involved in a sex-car crash on the New Jersey Turnpike. Comedian James McNair was killed in the accident.

Kevin Roper, the Walmart truck driver is being held responsible for the accident and has pleaded not guilty to charges of vehicular homicide and assault by auto. Prosecutors believe that he had not slept for 24 hours before the accident. He had allegedly not noticed that traffic slowed and swerved to avoid it, causing the crash.

Morgan is at the Robert Wood Johnson University Hospital in New Brunswick with fiance Megan Wollover. He underwent successful leg surgery, just hours after the crash on June 7.

Comedians Ardie Fuqua and Harris Stanton were also injured in the crash.
