Tracy Morgan and three other victims in last month’s fatal New Jersey Turnpike car crash, are suing Walmart, the company the truck driver who allegedly caused the accident worked for.
The accident occurred back on June 7, as the 30 Rock actor and other members of his team were on their way from a performance at the Dover Downs Hotel and Casino in Delaware.
According to a preliminary NTSB report, the truck driver, Kevin Roper, was speeding at the time and did not notice slowed traffic until it was too late. He then hit Morgan’s limo, which rolled over. Six cars were involved in the crash, which left comedian James McNair dead.
Roper appeared in court on June 11 and entered a not guilty plea. He is charged with vehicular homicide and assault by auto. He allegedly went 24 hours without sleep before the crash.
According to CNN, the lawsuit against Walmart was filed in U.S. District Court in New Jersey Thursday. “The defendants' negligence was a substantial contributing factor in causing plaintiffs' injuries,” the suit reads.
The Hollywood Reporter confirms that the other three plaintiffs are McNair’s wife, Krista Millea; Jeffrey Millea, Morgan’s assistant; and comedian Ardie Fuqua.
Walmart called the accident a “tragedy” in a previous statement and offered their condolences.
“As we’ve said, we’re cooperating fully in the ongoing investigation,” the company stated. “We know it will take some time to resolve all of the remaining issues as a result of the accident, but we’re committed to doing the right thing for all involved.”
Morgan is currently in a rehab facility. He was released from the hospital on June 20.
