Chris Brown’s day in court has been pushed back once more due to his inability to attend today because of travel issues.

In October of 2013, Brown and his bodyguard were charged with assaulting a young man outside of a Washington DC hotel. Bodyguard, Christopher Hollosy, was convicted back in April with a misdemeanor charge notes the Rolling Stone. Brown has yet to agree on a plea deal.

The “Loyal” singer is set to appear in a Washington, D.C. court on Tuesday, September 2nd. This is the third time Brown has attempted a plea deal. According to the Associated Press, Brown has twice rejected plea deals, in January and June respectively.

At the time of the assault, Brown was on probation for attacking his then-girlfriend Rihanna. The rapper has already completed several months of jail time for violating his probation for the 2009 case.

No comments have been made regarding the case by Brown’s legal team or by the spokesman for the U.S. Attorney.
