Nascar driver, Kurt Busch, is insisting that he never laid a finger on his ex-girlfriend, Patricia Driscoll, and that any reports of domestic violence were fabricated by Driscoll.

USA Today is reporting that the Dover Police Department in Delaware are currently investigating an allegation of domestic abuse brought to them by Driscoll, 36, against Busch.

Driscoll filed court documents on November 5 requesting that Busch stay away from her and her son. She has also requested that Busch, also 36, be evaluated by a psychiatrist, as well as a certified domestic violence treatment agency.

In the documents, Driscoll alleges that back on September 26, the weekend that the NASCAR circuit was in Dover, Busch was upset after a bad qualifying run. He was verbally abusive towards Driscoll, and even, "said he wished he had a gun so that he could kill himself," according to the documents.

The documents go on to allege that Busch physically attacked Driscoll, banging her head against a wall in his motor home three times. Driscoll says she was able to push Busch away from her and found safety in a neighboring motor home, where she treated her injuries with an ice pack.

According to TMZ, however, sources are saying that Busch and Driscoll had split up a week before the alleged incident. Busch was surprised that Driscoll showed up at his motor home, and admits that they got into an argument, but that he never physically assaulted her.

Busch's attorney, Rusty Hardin, told TMZ, "This allegation is a complete fabrication by a woman who has refused to accept the end of a relationship and Mr. Busch vehemently denies her allegations in every respect." He also added on that Busch fully intends to cooperate with the Dover Police Department during the investigation.

Days after the September 26 incident, Hardin claims he was contacted by someone claiming to be a representative of Driscoll looking to come to a monetary settlement regarding the incident, reports TMZ. That person resigned as Driscoll's representation just a few days later.

Attempts to get in contact with Driscoll have been unsuccessful.
