For those who wondered how in earth Netflix’s Orange is the New Black could be considered a comedy, you’re not alone.
The Academy of Television Arts & Sciences has now ruled the award-winning show as ineligible in that category at the Emmys, and have switched them to drama.
Variety reports OITNB won in the comedy category during last year’s Emmys, where they were nominated for 12 and won three. The show was also considered a comedy at the Golden Globes and Screen Actors Guild Awards.
Netflix had submitted a waiver to remain in the drama category for the Emmys but they were denied.
“Orange Is the New Black is a truly pioneering series and an iconoclast which has always defied genre or easy categorization,” Netflix’s chief content officer, Ted Sarandos, said in a statement. “While we’re disappointed in the committee’s decision, we believe that Orange represents the best of television in either category.”
Nine members of a panel reviewed all episodes in the third season and deliberated on which category they thought it should be placed in. A decision needed two-thirds of the vote.
The full list of nominees for this year’s Emmys will be revealed on July 16. As we previously reported, Jason Biggs won't be returning for Season 3.
