Bill Cosby’s request to have Judy Huth’s sexual battery lawsuit dismissed was rejected earlier this week. Huth claims she was sexually assaulted by the comedian in 1974, when she was 15.
Huth, now 55, filed her lawsuit in California back in Dec. 1 and she said a few days later that she had a witness who could back up her story.
While Huth was interviewed by detectives after filing a police report, the Los Angeles County District Attorney declined to move forward with the case, stating that the statute of limitations was up.
Still, the lawsuit continued and Cosby tried to get it dismissed. However, TheWrap reports that the California Court of Appeals rejected Cosby’s request.
“We are very happy about the Court of Appeal decision yesterday which allows Ms. Huth’s case to proceed rather than being dismissed,” Gloria Allred, who is now representing Huth, said in a statement. “It is very important to Ms. Huth that she be able to have her day in court in this case.”
Cosby is facing allegations from over 20 women, who claim that he sexually assaulted and drugged them. He also faces defamation lawsuits from Tamara Green and former model Janice Dickinson in response to his attorney Martin Singer’s comments that their allegations are not true.
