The molestation case that choreographer Wade Robson filed against Michael Jackson has been thrown out by Superior Court Judge Mitchell Beckloff.

Jackson died in 2009, but Robson filed the lawsuit against his estate in 2013.

On Tuesday, Beckloff dismissed the case for Robson waiting too long to take legal action, AP reports.

Robson’s lawyer Maryann Marzano said he will be appealing the case and taking legal action against the “Thriller” singer’s businesses.

After Robson filed documents two years ago claiming he was sexually abused over a 7-year period, he appeared on the Today show calling him a “pedophile and a "child sexual abuser.”

He’s seen backlash from his claims because he testified that he did not get sexually abused by Jackson during a 2005 testimony.

Jackson’s estate’s attorney, Howard Weitzman, was pleased with Judge Beckloff’s hearing on Tuesday, mentioning that testimony.

"Mr. Robson testified under oath in a courtroom that Michael never did anything improper with him," he said in an email.
