Patrick O’Connor, the lawyer who represented comedian Bill Cosby in the 2005 lawsuit filed by Andrea Constand, finally spoke out on Monday following the release of more excerpts from Cosby’s testimony. He said that the release has been completely one-sided, since Cosby himself cannot issue a new response.
O’Connor told the Philadelphia Inquirer that Cosby cannot comment on the case due to a confidentiality agreement in the settlement with Constand. He also noted that Constand’s own deposition is still sealed and that Cosby’s should have remained so as well.
“How that deposition became public without being court-sanctioned is something we are going to pursue and deal with very vigorously,” O’Connor told the Inquirer. “It's an outrage that the court processes weren't followed here.”
Back on Saturday, The New York Times published more excerpts from the transcript of Cosby’s deposition. In it, the former Cosby Show star outlined his relationship with Constand, how he would seduce other young women, how he would use drugs and how he kept the affairs from his wife. The Times reported that all this was publicly available and that the only thing previously sealed in the case was a 62-page memorandum of law.
Over 40 women have accused Cosby of raping and drugging them. Earlier this month, the 63-page memorandum was unsealed and portions were published by the Associated Press. However, the Constand case ended in a settlement before heading to trial, where 13 other women were ready to testify about their experiences with Cosby.
Cosby has never been convicted of rape.
