Kelly Rutherford has refused to hand over her children with ex-husband Daniel Giersch after gaining temporary custody of them this summer.

After a long, drawn out custody battle, the former Gossip Girl star was reunited with Hermes, 8, and Helena, 6 in June. However, she was ordered to send them back to their father in Monaco on Aug. 7, which she refused to do.

On Monday, she appeared on Good Morning America to respond to Gierch’s claims of “child abduction” and “kidnapping.”

“It's been very hard for the kids and I, it's been kind of cruel, in a way, because we just want to see each other and be together, and they're very young," she said, People reports.

"It put me as a parent in an odd place, because if nobody's taking jurisdiction, how do you put your children on a plane to a foreign country not knowing what's going to happen?"

She has already lost her bid to fight for custody of her children in the state of California and she’s currently trying the same in the state of New York.

The kids have been living in Europe since 2012.
